Oak trees are the most widely protected tree genus in the U.S. at the local level. In Texas, California, Georgia, and most of the Southeast, oaks require permits for removal in most cities with tree ordinances — often at lower DBH thresholds than other species. Heritage-designated oaks can be among the most difficult trees to get removal approval for.
Why Oaks Are Heavily Protected
Oaks support more wildlife species than any other tree genus in North America — over 400 caterpillar species alone use oaks as host plants. They're also among the longest-lived urban trees, taking 50–150 years to reach the sizes that cities most value. A 30" DBH live oak in Austin may be 200+ years old. Texas
Texas cities provide the strongest oak protection in the U.S. Austin's heritage tree ordinance makes live oaks 19"+ DBH among the most protected trees in the country — removal requires an arborist report and mitigation fees up to $500 per diameter inch. California
Valley oak protection is among the most significant in California. Many foothill counties (Napa, Sonoma, Santa Cruz, Contra Costa) have oak woodland conservation ordinances that regulate removal of valley and blue oaks even on private property. The protection threshold varies by county — some protect oaks as small as 4" DBH. Always check your specific county's oak ordinance.
Florida and Southeast
Live oak is protected in most Florida and Southeast coastal cities. Miami-Dade and Broward County consider live oaks specimen trees above 18" DBH, triggering a more intensive permit process. Atlanta requires permits for all oaks 6"+ DBH.
Frequently Asked Questions
In most cities with tree ordinances, "dropping acorns" or "making a mess" is not an approved reason for heritage tree removal. The permit will likely be denied or require alternative mitigation (targeted pruning, root barriers). If the tree meets the size threshold for protection in your city, you'll need to explore other solutions. An ISA-certified arborist can advise on management options that don't require removal.
Oak wilt (Ceratocystis fagacearum) is a valid and accepted reason for removal approval in most Texas cities — but you'll need documentation. An ISA arborist report confirming the diagnosis (lab testing is preferred) and documenting that treatment is not viable is typically required.
